Can My Employer Cancel My Health Insurance While I’m on Workers’ Compensation?
Under North Carolina’s Retaliatory Employment Discrimination Act (REDA), your employer cannot punish or retaliate against you for filing a workers’ compensation claim, including by canceling your health insurance or firing you. However, while most North Carolina employers are required to provide workers’ comp coverage for workplace injuries, they are not required to pay your health insurance premiums for you when you are off work for workers’ comp. Some employers will voluntarily continue to pay these premiums while you are out.
