Common Causes of Work-Related Spinal Cord Injuries

Here are some of the most common causes of on-the-job spinal cord injuries our attorneys see in North Carolina workers’ comp cases:

  • Falls from ladders, scaffolding, roofs, and other heights, especially common in construction and maintenance work
  • Slips and trips on wet or uneven surfaces, leading to high-impact falls
  • Strike-by incidents involving falling objects
  • Vehicle accidents involving forklifts, delivery trucks, company vehicles, and heavy equipment
  • Machinery accidents, such as getting caught in or between equipment
  • Improper lifting of heavy loads, causing acute spinal cord trauma
  • Structural collapses or explosions in high-risk industries like construction

Is a Spinal Cord Injury Covered by Workers’ Compensation?

An eligible employee who suffers a spinal cord injury while on the job may be covered by workers’ compensation. There are a few things to keep in mind that may impact coverage:

  • Most North Carolina employers with at least three employees typically must carry workers’ compensation insurance.
  • You do not have to prove someone was at fault for your spinal cord injury to get workers’ comp benefits.
  • However, you must prove that your injury is considered compensable under North Carolina law.
  • Your spinal cord injury must require medical treatment and/or cause you to miss more than seven days of work.

Our experienced attorneys can review your case to determine if your spinal cord injury qualifies for benefits.

Workers’ Compensation Benefits for Spinal Cord Injuries in North Carolina

Depending on the circumstances of your case, a North Carolina workers’ comp settlement for a spinal cord injury may pay the following benefits:

  • Medical benefits – Workers’ comp covers all medical treatment reasonably necessitated by your injury, from emergency response to surgeries to ongoing care. You can also be reimbursed for mileage to and from medical appointments more than 20 miles round-trip. If you are permanently handicapped, these benefits may pay for necessary modifications made to your home. (C.G.S. §§ 97-2, 97-25).
  • Temporary total disability (TTD) – If your spinal injury prevents you from working at all for more than seven days, you can receive TTD benefits equivalent to two-thirds of your average weekly wage, subject to a state maximum. These benefits can last up to 500 weeks, and in some cases, even longer. (C.G.S. § 97-29).
  • Temporary partial disability (TPD) – If you’re able to work in some capacity but earn less than before because of your injury, TPD benefits can cover two-thirds of the difference between your pre- and post-injury average weekly wages, subject to a state maximum (C.G.S. § 97-30).
  • Permanent total disability (PTD) – If your spinal injury involves severe paralysis of both arms, both legs, or the trunk, you may be entitled to total disability benefits for life (C.G.S. § 97-29).
  • Permanent partial disability (PPD) – If your workplace injuries cause permanent partial impairment or loss of function in a body part, PPD will continue to pay wage replacement for a set number of weeks based on the body part affected and the doctor’s impairment rating (C.G.S. § 97-31).
  • Vocational rehabilitation – These benefits help with job retraining, education assistance, or placement services to help you find gainful work suited to your ongoing limitations (C.G.S. § 97-32.2).
  • Death benefits – In fatal spinal cord injury cases, workers’ comp should cover funeral and burial expenses, as well as financial support for eligible dependents (C.G.S. § 97-38).
