nerve injuryA nerve injury can disrupt the brain’s ability to communicate with muscles and organs. An injury to the spinal cord, which extends from the base of the skull down the center of the back, can cause loss of sensation, loss of movement, and paralysis. Damage to peripheral nerves – nerves outside of the brain and spinal cord – can cause weakness, numbness, and pain. Muscle weakness and pain from nerve damage may be permanent.

Nerve damage is often caused by trauma, such as blows and violent collisions suffered in motor vehicle accidents, falls, or sports injuries. The intense pain caused by nerve damage can leave the injured person unable to work or perform simple daily tasks.

If you have suffered nerve damage or paralysis in an accident, you may be worried about how you will support your family and regain your quality of life in the years ahead. If you are dealing with nerve damage from an accident someone else caused, contact a Raleigh nerve injury lawyer at Younce, Vtipil, Baznik & Banks, P.A., today. Types of Compensation Available in a Nerve Injury Lawsuit

If someone else is at fault for an accident that left you with significant nerve damage, you may be able to recover compensation for your expenses and losses. This money typically comes from insurance, such as the at-fault driver’s auto liability insurance after a car accident or business liability insurance after a slip-and-fall accident at a retail store or another commercial enterprise. Insurance companies often seek to avoid making significant claim payouts, regardless of the facts of the case. In fact, if you receive a quick settlement offer after an accident, it is likely to be for far less than the actual value of your claim.

If you sustained nerve damage in a workplace accident, you may be entitled to workers’ compensation benefits. If your employer or a workers’ compensation insurance administrator disputes your worker’s compensation claim, we may be able to pursue an appeal on your behalf through the North Carolina Industrial Commission.

The attorneys at Younce, Vtipil, Baznik & Banks, P.A. will press insurance companies to pay full compensation for your losses. We will gather your medical bills to calculate all your medical expenses, estimate future medical costs if applicable to your injury, and account for other losses you have suffered as a result of the accident.

Under North Carolina law, the types of compensation that may be sought by filing a personal injury claim include money for:

  • Medical bills
  • Lost income
  • Property damage costs
  • Household assistance expenses
  • Pain and suffering
  • Mental anguish
  • Physical impairments
  • Decreased quality of life or enjoyment
  • Loss of consortium

If your nerve injury will cause chronic pain or permanent disability, you may seek significant compensation for your pain and suffering and/or emotional distress. We will consult with your doctor to estimate the costs of any future medical care you will need.

Once we have determined the full costs of your medical expenses and losses, we will present a demand letter to insurers. A demand letter typically leads to negotiations, which we pursue aggressively to obtain a full and fair settlement agreement.

Most cases can be settled, but if an insurer refuses to agree to a settlement you find acceptable, we will file a personal injury lawsuit and ask the court to hold the at-fault party and his or her insurers accountable to you. Our personal injury attorneys are skilled trial attorneys. We will be prepared to present a solid case that demonstrates to the court the full compensation you deserve.

Nerve Damage Injuries from Accidents

The nerves of the body’s nervous system transmit messages between the brain and the rest of the body. Motor nerves cause muscles to move body parts, and sensory nerves identify pain, pressure, or temperature. Autonomic nerves control involuntary body functions, like heart rate, blood pressure, and digestion.

Traumatic nerve damage in an accident can be caused by any blunt-force trauma, crush injuries, or lacerations that result in compressed, pinched, or torn nerves. Common nerve injuries include:

  • Brachial Plexus Injury. The brachial plexus is a network of nerves that originates in the neck and provides movement and sensation in the arms and hands. A blow to the neck or wrenching or twisting of the neck or shoulders can cause brachial plexus injury.
  • Thoracic Outlet Syndrome (TOS). The thoracic outlet is the bony ring formed by the top ribs just below the collarbone. Thoracic outlet syndrome occurs when trauma causes the rib, collarbone, or neck muscles at the top of the outlet to compress nerves there.
  • Ulnar Nerve Entrapment. The ulnar nerve transmits sensation and movement to the lower arm and hand. If it is compressed where it passes through the elbow or wrist, the result is pain, weakness, or tingling in this area. Nerve damage involving ulnar nerve entrapment is also known as bicycler’s neuropathy and Guyon canal syndrome.
  • Carpal Tunnel Syndrome. This is a nerve entrapment condition that involves compression of the median nerve that passes through a small tunnel surrounded by bone in the wrist. The median nerve gives feeling to the thumb and the index, middle, and ring fingers. People in jobs that require repetitive hand or wrist motions experience inflammation of the tissue that causes carpal tunnel syndrome.
  • Sciatica. Nerve pain in the leg is often caused by irritation or compression of the sciatic nerve. Sciatica originates in the lower back, radiates deep into the buttock, and travels down the affected leg.
  • Meralgia Paresthetica. This condition, also called Bernhardt-Roth syndrome, is caused when a sensory nerve in a leg becomes compressed, resulting in a burning sensation felt in the outer thigh.
  • Peroneal Nerve Injury. The peroneal nerve branches from the sciatic nerve and provides sensation to the front and sides of the legs and the top of the feet. This nerve also controls the muscles in the leg that lift the ankle and toes upward. Injuries to the peroneal nerve can cause numbness, tingling, pain, weakness, and a gait problem.
  • Tarsal Tunnel Syndrome (TTS). This compression of a nerve in the ankle where it passes through a tunnel formed by bones and ligaments causes numbness, pain, or a tingling sensation in the foot.

Paralysis affects the body from the point on the spinal cord where the injury has occurred and below. A cervical spinal cord injury may cause tetraplegia, the loss of function in the arms, legs, and torso. Paraplegia involves a nerve injury in the chest or lower back area that has led to a loss of function in the legs and perhaps the chest and abdomen.

How Nerve Damage Can Affect You

The symptoms of nerve damage depend on the location and type of nerves that are injured.

Motor nerve injuries may produce the following symptoms:

  • Paralysis
  • Weakness
  • Muscle atrophy
  • Twitching

Sensory nerve damage may produce symptoms such as:

  • Pain
  • Sensitivity
  • Numbness
  • Tingling
  • Burning
  • Problems with positional awareness.

Autonomic nerve damage may produce:

  • Inability to sense pain
  • Too much sweating or too little sweating
  • Lightheadedness
  • Dry eyes and mouth
  • Constipation
  • Bladder dysfunction
  • Sexual dysfunction.

Because paralysis is caused by damage to the spinal cord, the center of the nervous system, significant paralysis can include loss of motor, sensory, and autonomic nerve function.

Nerve damage may be treated with pain medication and/or physical therapy, orthotic devices, massage, and acupuncture. More serious peripheral nerve trauma may require reparative surgery. Paralysis cannot be cured.
